Terms of Service

Last updated: 11 September 2026

These Terms of Service ("Terms") govern your use of FortuneCode CRM, operated by Fortune Code ("we", "our", or "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

FortuneCode CRM is a multi-channel customer messaging platform. It lets a business connect the messaging accounts it already owns — including WhatsApp, Facebook Messenger, Instagram, Telegram, TikTok, email and SMS — and handle the resulting conversations from a single shared inbox, together with related tools such as contacts, campaigns, automations and reporting.

We sell the service to the business that owns those accounts. We are not a party to the conversations you hold with your own customers.

2. Your Account

  • You must provide accurate registration information and keep it current.
  • You are responsible for everything that happens under your account, including the actions of agents and team members you invite.
  • You are responsible for keeping your password and API keys confidential. Tell us immediately if you believe they have been exposed.
  • You must be legally able to enter into this agreement, and you must be acting for a business rather than as a consumer.

3. Third-Party Platforms

The service connects to platforms we do not control, including Meta (WhatsApp, Messenger, Instagram), TikTok, Telegram, and email and SMS providers. Your use of those channels is also governed by each platform's own terms and policies, and you are responsible for complying with them.

Those platforms may change, restrict, suspend or withdraw their APIs at any time. Where that limits or removes a feature, we will tell you, but we cannot be held responsible for a third party's decision about its own platform.

Number and account bans. Messaging platforms may restrict or ban an account or phone number for reasons of their own, including message volume, recipient reports, or the method used to connect. This is a decision of that platform, not of ours. You are responsible for the numbers and accounts you connect and for how you message your customers through them.

4. Acceptable Use

You may not use the service to:

  • send unsolicited messages to people who have not agreed to hear from you;
  • send unlawful, misleading, abusive, hateful or infringing content;
  • impersonate another person or business;
  • attempt to gain unauthorised access to the service, other tenants' data, or the underlying infrastructure;
  • resell or redistribute the service except under an Agency plan that expressly permits it;
  • circumvent plan limits, or use the service in a way that degrades it for others.

You must obtain and be able to evidence consent from the people you message, where the law or the platform requires it.

5. Plans, Fees and Billing

  • Subscription fees are stated in US dollars and charged in advance for the billing period you choose.
  • Subscriptions renew automatically at the end of each period unless cancelled before renewal.
  • Messaging charges levied by a third-party platform — for example WhatsApp conversation fees — are separate from your subscription and are billed against your account balance at the rates shown in the panel.
  • Plan limits, including connected numbers, agent seats and contacts, are enforced by the service.
  • We may change prices with at least 30 days' notice. A change never affects a period you have already paid for.

Payments are processed by our payment provider acting as merchant of record. Taxes are handled as required in your jurisdiction.

6. Refunds and Cancellation

Refunds are governed by our Refund Policy, which forms part of these Terms.

7. Your Data

You retain ownership of the data you and your customers put into the service. We process it to provide the service, as described in our Privacy Policy.

You can export your data at any time while your account is active. After termination we retain it for 30 days so you can retrieve it, and then delete it, other than records we must keep for legal or accounting reasons.

8. Availability and Support

We aim to keep the service available continuously, but we do not guarantee uninterrupted operation. Maintenance, third-party outages and events outside our control can interrupt it. Support is provided during our published business hours.

9. Suspension and Termination

You may cancel at any time from the billing screen. We may suspend or terminate an account that breaches these Terms, that is used unlawfully, or for which payment has failed, and we will give notice where it is reasonable to do so.

10. Liability

The service is provided "as is". To the fullest extent the law allows, we are not liable for indirect or consequential loss, for lost profits or revenue, or for loss caused by a third-party platform's own acts. Our total liability in any twelve-month period is limited to the fees you paid us in that period.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Changes

We may update these Terms. Material changes will be notified in the panel or by email before they take effect. Continuing to use the service after that constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Arab Republic of Egypt, and the courts of Egypt have jurisdiction over any dispute, without prejudice to any mandatory protection available to you where you are established.
